By accessing or using this website, our patient portals, career page, or any connected services (collectively, the “Services”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services. 

2) Eligibility 

The Services are intended for individuals 18 years and older. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian 

3) Not Medical Advice 

Information provided through the Services is general information only and is not medical or nursing advice. Always seek the advice of your physician or other qualified health provider regarding a medical condition. 

4) No Guarantees of Service Availability 

We may modify, suspend, or discontinue the Services or any features at any time without notice. We are not liable for downtime or data loss. 

5) Accounts & Security (if applicable) 

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of unauthorized access. 

6) Acceptable Use & Prohibited Conduct 

You agree not to:

  • Upload or transmit malware, unauthorized PHI/PII, or infringing content;  
  • Scrape, crawl, or use automated means outside of permitted API use;  
  • Interfere with site operation, security, or access controls;  
  • Misrepresent your identity or affiliation. 
7) Intellectual Property 

The Services, including text, graphics, logos, images, and software, are owned by or licensed to Qualcare Nurse Registry Inc. and protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. 

8) Third-Party Links & Services 

Our Services may link to third-party sites or services (e.g., payment processors, EHR portals). We do not control or endorse those third parties and are not responsible for their content, policies, or practices. 

9) Disclaimers 

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. 

10) Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Qualcare Nurse Registry Inc. AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. 

11) Indemnification 

You agree to defend, indemnify, and hold harmless Qualcare Nurse Registry Inc. from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms. 

12) Governing Law; Dispute Resolution 

These Terms are governed by the laws of State of Florida, without regard to conflict of law principles.
Option A (Litigation): You agree to exclusive jurisdiction and venue in the state or federal courts located in Broward County, Florida.
Option B (Arbitration): At our election, disputes will be resolved by binding arbitration on an individual basis with a class action waiver under Selected Arbitration Rules in Broward County, Florida 

13) Changes to Terms 

We may update these Terms at any time. Changes will be effective when posted with an updated “Effective Date.” Your continued use after changes constitutes acceptance. 

Privacy Policy 

1) Who We Are & Scope 

This Privacy Policy explains how Qualcare Nurse Registry Inc. collects, uses, discloses, and safeguards information when you visit our website or interact with our Services, including SMS and email communications. This Policy is separate from our HIPAA Notice of Privacy Practices, which governs our use of Protected Health Information (PHI) in our capacity as a health care provider. 

2) Types of Information We Collect 
  • Information You Provide: contact details, service inquiries, intake forms, preferences, consents, reviews/testimonials, job applications.  
  • Health Related Information: If you submit symptoms, conditions, care needs, insurance details, or other potentially PHI via forms/portals, we treat it in accordance with HIPAA where applicable.  
  • Automatic Data: device info, IP address, browser type, pages viewed, referring URLs, timestamps, approximate geolocation, and cookie identifiers.  
  • From Third Parties: referral sources, care partners, EHR systems, payment processors, marketing/analytics providers, and communication platforms. 
3) How We Use Information 
  • Provide, operate, and improve the Services;  
  • Schedule assessments and coordinate care;  
  • Verify identity and manage accounts;  
  • Respond to inquiries and deliver customer support;  
  • Send transactional notices and service updates;  
  • Send marketing communications (with your consent where required);  
  • Comply with legal, regulatory, and audit obligations (e.g., HIPAA, state privacy laws);  
  • Prevent fraud, secure the Services, and enforce our Terms. 
4) Legal Bases (where applicable) 

Where required we rely on one or more legal bases: consent, contract performance, legal obligations, vital interests, public interest, or legitimate interests (balanced with your rights). 

5) Cookies & Similar Technologies 

We use cookies, pixels, and similar tools for site functionality, analytics, and (with consent where required) advertising. You may control cookies in your browser or via our cookie banner/preferences center. Disabling certain cookies may affect site functionality. 

6) Sharing & Disclosure

  • Service Providers/Processors (hosting, EHR, billing, call/SMS/email platforms, analytics, security, IT support);  
  • Care Partners/Referrals (with proper authorization or as permitted by law);  
  • Legal/Regulatory Authorities (to comply with law or protect safety, rights, or property);  
  • Business Transfers (in connection with mergers, acquisitions, or asset sales);  
  • With Your Consent (e.g., testimonials, referrals).
    We do not sell PHI. For non-PHI personal information, we do not “sell” or “share” for cross-context behavioral advertising unless expressly disclosed and consented to per applicable law. 
7) Data Retention 

We retain information for as long as necessary to provide Services, comply with legal obligations (including medical record retention periods), resolve disputes, and enforce agreements. 

8) Security 

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information (including PHI where applicable). No system is 100% secure; use caution when transmitting information online. 

9) Children’s Privacy 

We do not knowingly collect personal information online from children under 13. Parents or guardians who believe a child has provided information should contact us to request deletion. 

10) International Transfers 

If you access the Services from outside the United States, your information may be processed in the U.S. and other countries that may have different data protection laws. Where required, we implement appropriate transfer safeguards. 

11) Do Not Track 

We currently do not respond to “Do Not Track” browser signals. You may manage advertising choices via your browser settings and our cookie preferences tools. 

12) Changes to this Policy 

We may update this Privacy Policy periodically. We will post changes with an updated “Effective Date.” Material changes may be additionally notified (e.g., via banner or email where appropriate). 

ADRD Training
430.5025 F.A.C.— Florida statute establishes universal Alzheimer’s disease and related dementias (ADRD) training requirements to be used by nursing homes, home health agencies, nurse registries, companion or homemaker service providers, health care services pools, assisted living facilities (ALF), adult family-care homes (AFCH), adult day care centers (ADCC), and care settings that provide specialized Alzheimer’s services. 
This training program must be completed on the Department’s website on an individual basis to access to the Certificate of Completion Request form and obtain a unique certificate of completion. If the program is watched on any other platform, then employees and contractors will not be eligible to receive a certificate of completion. This program does not currently support group training settings.
